Man taken into custody regarding fatal crash
A 26-year-old man has been taken into police custody regarding a crash at a Coral Cables intersection that killed two and injured the driver himself. The accused driver was allegedly speeding and intoxicated when he struck a Toyota Corolla from behind. The Toyota Corolla was reported to be stopped at a red light at the intersection of 8th Street and 37th Avenue and contained a 44-year-old woman and a 34-year-old man. Both were residents of Sweetwater.
According to the reports, the driver and passenger within the Toyota Corolla were both killed at the scene of the fatal accident. The 26-year-old driver was reportedly intoxicated when he crashed into the Toyota Corolla. The driver’s intoxication was discovered through toxicology reports. After responding to the scene of the accident, the local police obtained an arrest warrant for the 26-year-old driver.
The 26-year-old driver was injured during the accident and was treated in Jackson Memorial Hospital. According to reports, the man was taken into custody at the hospital. He will be transferred to Dade County Jail.
The families of the two killed in the car crash can pursue wrongful death charges against the 26-year-old driver who was allegedly both speeding and intoxicated at the time of the crash. A wrongful death charge can compensate the families for the loss of their loved one. Wrongful death charges can be filed with the aid of a personal injury attorney. The toxicology reports may be able to serve as evidence that the driver was intoxicated at the time of the accident. Wrongful death will apply if it can be shown that the driver and passenger would not have died if the driver had not made the choice to drive while intoxicated. Wrongful death is often used in cases when death was foreseeable or could have been avoided.
