Did My Doctor Commit Medical Malpractice?
Whether or not your doctor committed medical malpractice will depend on whether he or she did everything that a reasonably prudent doctor in your area would have done. For example:
- Did your doctor take the time to check you for visible signs of illness?
- Did your doctor recommend appropriate cancer screening tests?
- Did your doctor observe symptoms of cancer but misdiagnose them?
- Did the lab that performed screening tests do its job correctly?
- Did your doctor correctly interpret lab test results and inform you promptly?
To have a case of medical malpractice, both of the following must be true:
- Your doctor had an opportunity to diagnose your cancer but failed to do so.
- The delay in your cancer diagnosis made a difference in the outcome.
Some forms of cancer are so virulent that early diagnosis and treatment may not make a significant difference in the length and quality of a patient’s life. Other forms of cancer, such as colon cancer, breast cancer, and melanoma, are usually survivable if treated before cancer spreads.
